The Terms & Conditions  – for Online Booking and Reservation of our outdoor adventure tours determine the conditions under which the service provider, Obrt za usluge “RAFTING APEX” (hereinafter referred to as Rafting Apex Adventure), provides the services to its buyers (hereinafter referred to as the Clients) through our websites. Through our online platform, we provide an offer of tour services. These general terms and conditions only apply to our services as a service for the search, collection, discovery, connection and purchase of tour services and may differ from the general terms of our associates. Rafting Apex Adventure has no control over associate service providers, travelers and other users of the online platform. Rafting Apex Adventure cannot manage transport services and will not be held responsible for any failure or delay in the performance of services of any of its obligations under these Terms if such default or delay is caused by situations that are completely beyond their control, including, without limitation, a natural disaster. The failure, restriction or regulation of any Government body, including compliance with any Government order, provided that all delays or defaults are corrected as soon as possible using all reasonable means after the cause of such default has been remedied.

GENERAL

Rafting Apex Adventure is a small family-owned business where we create, market, and sell tours that focus primarily on outdoor adventure. Our team is formed by white water and outdoor professionals certified by IRF (International Rafting Federation), HGSS (Croatian Mountain Rescue Team) and Rescue 3 Association who share a passion for travel, respect for the environment, and different cultures. Over the years we have formed long and trusting partnerships within the communities we work in, engaging individuals and businesses in our tours. This approach is responsible for our success and who we are today. We are also committed to designing and operating our tours in a way that ensures minimal impact on the environment. Our guides practice “Leave No Trace” principles on trails. We consider it our responsibility to devote efforts to maintain and preserve the integrity of nature.

TERMS OF SERVICE

The Client is obligated to provide any information which is required for the reservation process. The Client is obliged to read the terms and conditions before booking and confirming. It is very important that you notify us if you have medical problems, and what medication you use. Please let us know before we start the trip. Our customers are of course responsible for their own behavior. We demand that local laws are followed, and will not tolerate the use of illegal drugs, or any violation of Croatian law. Our guides reserve the right to ban people from the boat in case they endanger the safety of the rest of the team. In this case, there will be no refund of payment. We reserve the right of changing the itinerary for smooth operations or to enhance the guest experience. In case of alternation, or omission due to reasons beyond our control (although every effort would be made to provide the services as per the schedule) the operator will not be liable for any claims. We will not be held responsible for any loss, damage, accident, death, injury, etc. of any nature. If the trip is canceled due to Rafting Apex Adventure fault, those who have paid for the trip will get a full refund. We are not responsible for other expenses you have had while preparing for this trip, for example things like a bus ticket, taxi, equipment or other expenses.

Services as well as content about the Services, including without limitation text, descriptions, products, software, graphics, all page headers, button icons, scripts, photos, interactive features, services and all related intellectual property rights, and any other content on the Services (The “Content”) and the trademarks, service marks and logos contained in them (the “Tags”) are owned or licensed by us. Contents of the Services are provided to you for information and personal use only, and may not be used, copied, distributed, transmitted, displayed, sold, licensed or otherwise used for any other purpose without our prior written consent. We reserve all rights not expressly granted in and to the Services. You will not remove, modify or conceal any copyright, trademark, service marks or other copyright notices defined in and to the Services and/or Content. By using our Services, you agree that you will not circumvent, disable or otherwise interfere with the security features of the Services or features that prevent and/or restrict the use and/or copy of any Content or impose restrictions on the use of the Services. Rafting Apex Adventure, the Rafting Apex Adventure logo and other marks are trademarks of Rafting Apex Adventure or the tags of our business partners and associates. All other trademarks, service marks and logos used on our site are the trademarks, service marks or logos of their respective owners.

By using our services, you agree to:

• you agree to all applicable laws regarding your use of the Services. These include all privacy laws, intellectual property laws, and other laws and regulatory requirements;
• you will provide us with accurate information and update as necessary; and/or act fairly and in good faith.

By using our services, you agree not to:

• slander, abuse, threaten, harass, abuse, intimidate, harm another person and/or engage in any other predatory behavior, including sending unsolicited communication to others or engaging in any other predatory behavior and/or inciting others to commit violent acts;
• use and/or attempt to use someone else’s account and/or create a false identity;
• share information of other users or third parties without their explicit consent;
• duplicate, license, sub-license, publish, transmit, distribute, display, sell, rename and/or otherwise transmit the information found in the Services, except as permitted in these Terms or as expressly granted to you;
• collect, collect, use, copy or transmit any personal information, including personal information obtained from the Services (unless expressly permitted by the owner of such information).

ADDITIONAL TERMS AND CONDITIONS

Rafting Apex Adventure does everything it can to ensure the information on the Internet is accurate. However, we cannot guarantee and are not responsible for the accuracy of the information; any action taken based on information from the Rafting Apex Adventure site is your responsibility. If you are not sure what service to choose, feel free to contact our staff for advice. By booking or reserving our service, the Client accepts small changes that may occur such as changes due to delays caused by traffic or due to other circumstances not caused by the Rafting Apex Adventure negligence. In the event of cancellation, the Buyer will receive a refund. In the event of a scheduled or necessary change, Rafting Apex Adventure will inform the Client by e-mail and/or SMS. The Client is obliged to check e-mail and/or SMS 12 hours before the tour to find out if there are any changes in the timetable.

AMENDMENTS TO TERMS AND CONDITIONS

The range of our services will continue to expand in the future and it is therefore possible to amend these terms at any time. If you do not agree to any changes to the terms or to certain terms, please discontinue using our services before these changes take effect.

PRIVACY POLICY

Rafting Apex Adventure considers the privacy of its clients and visitors extremely important and therefore takes it very seriously. In protecting your personal information, we have taken all necessary technical and organizational measures in accordance with best practices and obligations arising from the Personal Data Protection Act, the General Regulation on the Protection of Personal Data, the Law on the Implementation of the Personal Data Protection Regulation and the Electronic Communications Act.
No information from our site visitors has been automatically collected without your consent. All data collected is stored in accordance with the General Data Protection Regulation (GDPR). GDPR EU regulation defines personal information very broadly as name, surname, OIB, address, telephone number, e-mail address, credit card number, financial information, accounts on online services, etc. Accordingly, personal information is all information relating to an individual whose identity is established or identifiable, that is, anything that can be directly and indirectly accurately related to an individual. Any personal information you enter on our site is used solely for the purpose of creating travel tickets with your information. Your first and last name, e-mail and contact number are used only for the purpose of providing the service, as well as for contacting you in the event of a change in your reservations. You will only receive special offers and a newsletter on your email if you sign up for the newsletter, so you can unsubscribe from the email at any time. No company or person will ever receive your information from us, except for requests coming from government institutions.

If you would like to remove your personal information from our database, all you have to do is send us an email at rafting.apex@gmail.com and let us know. The person whose personal data is processed has the right to access the data as well as to know who is the user of his personal data. If the personal data we process are incomplete, inaccurate or up-to-date, we are obliged to supplement, correct or update them either at the request of the respondents or ex officio and we are obliged to notify you within 30 days. The information on our website is protected and encrypted with SSL technology, which enables the secure exchange of information between your browser and our pages. Rafting Apex Adventure owned websites contain links to other sites not owned by Rafting Apex Adventure. Such sites contain their own privacy statements and Rafting Apex Adventure assumes no responsibility for the contents of other sites.
